DMCA Policy

1. Overview

portwarp ("the Service") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we respond to valid notices of alleged copyright infringement and, where appropriate, disable access to or remove the infringing material.

Because portwarp provides reverse-proxy tunneling, content served through a tunnel originates from the user's own machine. We do not host, inspect, or store the content passing through tunnels, but we can suspend or terminate a tunnel or account that is used to infringe copyright.

2. Filing a Takedown Notice

If you believe content made available through the Service infringes your copyright, send a written notice to our designated agent (see Section 5). To be valid under the DMCA, your notice must include:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the infringing material and the URL, tunnel address, or information reasonably sufficient to let us locate it.
  • Your contact information: full name, mailing address, telephone number, and email address.
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act on the owner's behalf.

3. Counter-Notice

If your content was removed or disabled and you believe this was a mistake or misidentification, you may submit a counter-notice to our designated agent. A valid counter-notice must include:

  • Your physical or electronic signature.
  • Identification of the material that was removed and the location where it appeared before removal.
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the courts in your district and will accept service of process from the party that filed the original notice.

4. Repeat Infringers

In accordance with the DMCA and other applicable law, we will, in appropriate circumstances, suspend or terminate the accounts of users who are found to be repeat infringers. We reserve the right to disable tunnels or terminate accounts at our discretion.

5. Designated Agent

Send DMCA notices and counter-notices to our designated agent at [email protected]. Please include "DMCA Notice" in the subject line so we can process your request promptly.

Filing a false or bad-faith notice may expose you to liability for damages, including costs and attorneys' fees, under Section 512(f) of the DMCA.

6. Changes to This Policy

We may update this DMCA Policy from time to time. Continued use of the Service after changes constitutes acceptance of the updated policy. This policy operates alongside our Terms of Service and Privacy Policy.
